Tripura AG declines TMC leader's plea to initiate contempt proceedings against CM Deb

RTI activist and Trinamool Congress leader Saket Gokhale’s plea to initiate contempt of Court proceedings against Chief Minister Biplab Kumar Deb was declined by Advocate General Siddhartha Shankar Dey. CM Deb's remarks on the judiciary had sparked row in Tripura.

Agartala:Advocate General Siddhartha Shankar Dey turned down Trinamool Congress leader Saket Gokhale’s plea of initiating contempt of Court proceedings against Chief Minister Biplab Kumar Deb in connection with his recent remarks on the judiciary.

Gokhale, an RTI activist, who joined the Trinamool Congress recently wrote to the advocate general terming Deb's remarks during a programme of civil servants as “scandalous”.

Responding to his letter, Dey said, “Neither the source of the three comments attributed to the Chief Minister of Tripura has been revealed nor authenticity thereof or for that matter, any statement made in the Application has been owned or verified in any manner so as to be acted upon.” He further said that the contents of media reports in this connection have already been publicly refuted by the Chief Minister, on Facebook. The print copy of which was also submitted for the perusal of Chief Justice, Tripura High Court on September 27. “Under the aforesaid circumstances, sanction under Section 15 of the Contempt of Courts Act, 1971, as sought for, is declined,” Dey replied.

Gokhale in his letter said that no person including Chief Minister is above the law and defying orders of the judiciary is a direct attack on the justice system. “No person, including the Chief Minister of a state, is above the law. The orders of the judiciary apply to every person equally and the publicly stated intention of the accused, who is also the Chief Minister of Tripura, to defy the orders of the judiciary is a direct attack on the justice system”, Gokhale mentioned in his letter.
