SC refuses to grant relief to LG polymers, asks to raise issue before HC

After Andhra Pradesh High Court ordered the seizure of the premises of LG Polymers in Visakhapatnam gas leak case, the Supreme Court refused to entertain the plea and directed the petitioner to highlight the issue before the HC expeditiously and adjourned the matter to be heard on June 8.

New Delhi: The Supreme Court on Tuesday refused to allow the LG polymers' employees to access the plant which is currently sealed and seized after the Andhra Pradesh High Court ordered to do so granting liberty only to the investigative committee members to enter into the factory premises.

The court directed the company to give a list of 30 personnel to the District Collector by 3 pm today who may be granted access to the plant.

Senior Advocate Mukul Rohatgi appearing for the LG Polymers raised three issues before the top court. Firstly, he questioned how can there be a jurisdiction without the Supreme Court's participation.

Secondly, he informed the court that there might be things lying inside the plant which could prove to be hazardous, and thirdly, he asked the court to allow the company to participate to prevent any mishap from the material lying inside. The HC had also directed to not shift anything from the plant without its prior approval.

Rohtagi pleaded before the court that the company needs emergency access and after one week he will file a transfer petition before the HC. He said that he will be willing to cooperate with anyone and is not running away, he just wants to participate.

The bench refused to entertain the plea and said that the NGT or HC will hear the matter.

The bench directed that the issues may be highlighted before the HC expeditiously and adjourned the matter to be heard on 8th June.
