SC dismisses Anil Deshmukh's plea seeking quashing of FIR

The bench comprising of Justice DY Chandrachud and Justice MR Shah refused to overrule the Bombay High Court order which had refused to set aside the FIR, adding that there is "no error in the judgement."

New Delhi:The Supreme Court has dismissed Maharashtra's former Home Minister Anil Deshmukh's petition seeking to quash the FIR registered by Central Bureau of Investigation (CBI) against him in corruption case.

The bench comprising of Justice DY Chandrachud and Justice MR Shah refused to overrule the Bombay High Court order which had refused to set aside the FIR, adding that there is "no error in the judgement."

Deshmukh's counsel told the court that the CBI could investigate into a state matter only with prior consent of state under section 17 A. However, the court dismissed it saying that they can't term an investigation invalid when it has been ordered by a constitutional court.

"If the CBI investigates, can the government of India or state say that you can't investigate my officer? If this happens then the entire purpose of directions of the court gets defeated," said Justice Chandrachud.

Maharashtra government's petition against the CBI enquiry was also dismissed by the court today saying that they should allow full and flair trial and not defend their former minister.
