New Delhi: The Centre for Public Interest Litigation has filed a plea in the Supreme Court seeking quashing of appointment of Rakesh Asthana as the Delhi Police Commissioner and appointing someone new in accordance with the top court's judgement in the Prakash Singh case.
"We therefore clarify the order of this court dated 3-7-2018 passed in Prakash Singh vs Union of India [Prakash Singh v Union of India (2019) 4 SCC 13] to mean that recommendation for appointment to the post of Director General of Police by the Union Public Service Commission and preparation of panel should be purely on the basis of merit from officers who have a minimum residual tenure of six months i.e., officers have at least six months of service prior to the retirement," states the Prakash Singh judgement.

Rakesh Asthana was appointed just four days prior to his superannuation.
"Impugned orders are in clear and blatant breach of the directions passed by this Hon'ble court in the Prakash Singh case as (i) respondent no.2 (Rakesh Asthana) did not have a minimum residual tenure of six months; (ii) no UPSC panel was formed for appointment of Delhi Police Commissioner and (iii) the criteria of having minimum tenure of two years has been ignored," read the plea.
Asthana has been appointed for a period of one year till his date of superannuation even though the court's judgement provides for a minimum tenure irrespective of the date of superannuation.
One plea has already been filed in the court and this is a fresh plea filed through Advocate Prashant Bhushan.
