KA: Court slaps 6 month jail to Pakistani woman sexagenarian for visa violation 8 years later

The Karwar District Sessions Court sentenced Bhatkal's husband and his Pakistani-origin wife prison term and fined for violating visa rules and the Foreigners Act provisions.

Uttar Kannada:The Karwar District Sessions Court sentenced a male septuagenarian and his sexagenarian wife, who is of Pakistani origin, to jail and fined for violating visa rules by bringing her to India after marrying her. They were convicted under the provisions of the Foreigners Act as well, eight years and six months after the case was filed.

Those convicted are identified as Mohammad Ilyas, (70) a resident of Maulana Azad Road, Bhatkal taluk of Uttar Kannada district and his Pakistani origin wife Nasira Parveen, (63). The couple were married on May 4, 1980 and Parveen had been staying in Karwar.

According to police, Mohammad Ilyas took his wife, a Pakistani citizen, to Delhi from Bhatkal for visa extension without informing the local police station and the Foreigners Registration Officer (FRO) of Karwar, earlier on June 17, 2014. Parveen's visa will have to be renewed every six months.

As per law, the couple must have intimated the FRO and the local police before they appear for visa extension through the established channels. Following an official complaint, the Bhatkal Nagar police station registered a case against the couple on August 1, 2014.

After a probe, Inspector Prashanth S Nayak filed the chargesheet against the couple on March 17, 2015. The court which was hearing the case accepted the submissions from the prosecution in respect of visa rules violations and the Foreigners Act before it passed the verdict.

Karwar District Sessions Court Judge DS Vijayakumar sentenced Mohammad Ilyas to one month simple imprisonment and imposed Rs 10,000 as fine. Parveen was awarded 6 months simple imprisonment and Rs 10,000 fine. Public prosecutor Tanuja V Hosapatna advanced the arguments on behalf of the government.
