Delhi minor rape case: Complaint against Rahul Gandhi for posting photo of victim's family

A complaint has been filed with Delhi Police against Congress leader Rahul Gandhi for sharing his photo along with the parents of a 9-year-old girl who was allegedly raped and murdered in Delhi.

New Delhi:A complaint has been filed with Delhi Police against Congress leader Rahul Gandhi(राहुल गांधी) for sharing his photo along with the parents of a 9-year-old girl who was allegedly raped and murdered in Delhi. Rahul Gandhi has been vocal and in the forefront raising the case as his visit to the victim's family hit headlines last day. Vineet Jindal, a Delhi-based lawyer has filed the complaint against Rahul Gandhi.

The complainant Jindal stated in his complaint that Rahul Gandhi shared his own photo on Twitter along with the father and mother of the child victim which becomes discloser of the identity of the minor victim.

Delhi Police has been requested to register FIR against Rahul Gandhi under pertinent sections and take stringent legal action.The act of Rahul Gandhi is an offence under section 23 of Protection of Children from Sexual Offences (POCSO) Act, 74 of Juvenile Justice (Care and Protection of Children) Act, 228A of Indian Penal Code (IPC), as per the complainant's statement.

Rahul Gandhi's tweet sharing the photo of the victim's parents triggered row last day also."Parents' tears are saying only one thing -- their daughter, the daughter of this country, deserves justice. And I am with them on this path to justice," he wrote on Twitter. Child rights body National Commission for Protection of Child Rights (NCPCR) on Wednesday asked Twitter to take action against him saying it violates the Juvenile Justice and POCSO Acts. BJP's national spokesperson Sambit Patra(संबित पात्रा) also urged NCPCR to take stringent action against Rahul Gandhi.

Rahul Gandhi met the family of the minor girl who was allegedly raped, murdered, and cremated without her parents' consent in Delhi's Old Nangal crematorium on Wednesday. "I spoke with the family, they want justice and nothing else. They're saying that justice is not being given to them and they should be helped. We will do that. I have said that I am standing with them," Rahul Gandhi said.

"Parents' tears are saying only one thing- Their daughter, the daughter of the country deserves justice. And I am with them on this path of justice," tweeted Rahul, minutes after he had met the parents of the minor girl. Earlier on August 3, the Gandhi scion had shared a media report of the incident on the microblogging site and tweeted, "The daughter of a Dalit is also the daughter of the country."

What the minor rape case is all about?

The nine-year-old girl, resident of Delhi's Cantonment area was allegedly raped and murdered on Sunday. The issue came to light after the minor girl was cremated without her parents' consent at Old Nangal crematorium after she was found dead there. A priest working at the crematorium, who had pressurized the family to perform the last rites of the dead body, had been charged with murder.

According to the parents, the minor girl had gone to get cold water from the water cooler at the crematorium but did not return for a long time. It was then that they were informed by the priest that the girl allegedly died of electrocution while trying to get cold water from the water cooler. The priest had also told the girl's parents to refrain from filing a case in the police station, saying that if the girl's body would be taken to a hospital, her organs would be stolen.

The girl's parents and relatives have also alleged that burn marks were observed on the body of their daughter, unlike that of electrocution. The accused priest and three other men have been booked under Sections 302, 376 and 506 of the Indian Penal Code, along with the relevant sections of the Protection of Children from Sexual Offences (POCSO) Act and the SC/ST Act.
