'Vikas Dubey encounter not fake': UP govt tells SC

UP govt submitted an affidavit in the apex court denying the allegation that the gangster Vikas Dubey's encounter was fake. It also assured the court that it has followed the guidelines and Dubey never intended to surrender.

New Delhi The Uttar Pradesh government submitted an affidavit in the Supreme Court on Friday in the case regarding Gangster Vikas Dubey's encounter and denied the reports claiming it to be a 'fake encounter'.

"Satisfying the Hon'ble Court that facts as reflected here reveal that the incident in question can never be termed as 'fake encounter' looking at the incident in totality," read the reply of UP government.

Assuring the court that it has followed the guidelines laid and the investigation is ongoing in the case, UP govt informed the top court that Dubey never intended to surrender, as media reported, and was identified at Mahakaal Temple, Ujjain, after which he was taken into custody.

Submitting other clarifications on the media reports, the UP government says that he was escorted by 15 police personnel, 3 vehicles and he was being transferred from vehicles for security reasons.

Adding on further, the state government said that, "No locals came to the site claiming they had heard gunshots. Near the accident site, there was no habitation/houses. Due to heavy rains, there was no pedestrian movement also. Video of heavy rains is recorded."

UP govt informed that Dubey had run more than 3 km after the killing of 8 policemen and "his fast and covert travel across several states in a couple of days is a clear testimony of his perfect mobility."

Also, the doubt how the police fired accurately 4 bullets, the government said that the police fired 6 and only 3 had hit the accused gangster. "It was a close and face to face exchange of fire in furtherance of self-defence by Police," read the affidavit.

"Accused had fired 9 rounds at the STF team. He was facing the police while firing. STF team fired 06 rounds when he did not surrender even after warning and continued to fire on the police team. Only three bullets shots hit the accused. It was a close face to face exchange of fire furtherance if self-defence by police," read the affidavit.

As per the affidavit, there was no such decision to bring in a chartered plane because an STF team had left from Lucknow by road to join the existing raiding teams at Guna.

The affidavit has come in response to petitions seeking an inquiry into the encounter of Vikas Dubey and his aides as the petitioners apprehend that it was a fake encounter done for a larger conspiracy.
