SC to pass interim order on plea challenging Maratha reservation on July 15

The Supreme Court said that the petition challenging Maratha reservation bill will be heard in a day-to-day hearing. A three-judge bench heard the case and said that an interim order will be passed on July 15.

New Delhi: The Supreme Court on Tuesday said that it will take up the petitions challenging the constitutionality of Maratha reservation law next month and hear it on a day to day basis.

The apex court said that it will pass interim orders on the case on 15th July. Till then, the advocates are required to give their written submissions and whatever additional documents they need to file.

A three-judge bench led by Justice LN Rao was hearing a petition challenging the Bombay High Court's order which had granted 12-13% quota to Marathas in education and jobs under SEBC Act.

The petitioners said that the order breaches the 50% reservation cap fixed by the constitution bench in the Indira Sawhney judgement.

Advocate Shyam Divan, appearing for a petitioner said that the total quota is 72% now.

The bench said that they wish to hear the case on day to day basis and will give dates for it next month.

It asked the advocates to hold a conference among themselves and decide time each of the lawyers will take for presenting their case.

Advocates pressed for immediate dates, however, the judges denied.

"Please don't insist on immediate date. Please understand a 5 judge bench can not sit during these times," the bench said.

The court said that it will pass interim directions next week after hearing all the counsels.
