PIL in SC seeking independent probe into gangster Rakesh Pandey's encounter

The Uttar Pradesh Special Task Force (STF) gunned down Rakesh Pandey, an accused in the 2005 murder case of BJP leader Krishnanand Rai, in an encounter near Sarojini Nagar Police Station in Lucknow. A petition has been filed by Advocate Vishal Tiwari in SC seeking registration of FIRs against the police officials who conducted the encounter and also sought CBI probe against them.

New Delhi: A Public Interest Litigation has been filed in the Supreme Court seeking an independent probe into gangster Rakesh Pandey's aka Hanuman Pandey's encounter that happened on Sunday.

The petition has been filed by a Supreme Court Advocate Vishal Tiwari and sought registration of FIRs against the police officials who conducted the encounter and also sought the CBI probe against them.

He also seeks constitution of three-member inquiry commission comprising of retired HC judges and headed by former SC judge.

Criticising the police, Tiwari said that the inquiry into gangster Vikas Dubey's killing had "just begun" and now these other alleged encounters were done by the police and same old story of retaliation is spun like Dubey's and Hyderabad encounter.

"During the hearing of Vikas Dubey matter in the apex court, CJI SA Bobde had expressed disappointment and had warned of such incidents happening again and yet UP police are putting aside all warnings and challenging the Supremacy of Judiciary,' he said.

Contending the grounds for his plea, the advocate says that extrajudicial killings, custodial killings, custodial deaths, fake deaths etc do not solve the purpose but cause a lot of violence which crushes the fundamental rights of citizens.

"No law permits revenge i.e Eye for an Eye. If an accused has been caught whatever heinous crime he has committed police has got no authority to kill him in revenge. The only judiciary has got the power to give punishment as per to law. When common people are killed in any mashup of crime than police hardly registers the FIRs of victims, the victim has to fight very strongly for justice, he approaches from door to door. But when any crime is committed against police than police takes the law into its hand and becomes complainant, the prosecutor and judge in itself and in revenge just commit custodial killing and fake encounters," read the plea.

On Sunday morning, the UP Special Task Force(STF) gunned down Rakesh Pandey alias Hanuman Pandey, accused in 2005 murder case of Krishnanad Rai, in an encounter near Sarojini Nagar police station in Lucknow Kanpur Highway. The police claim it to be firing in retaliation.
