CPI (M) moves to SC seeking 50% reservation for OBCs in Medical courses in Tamil Nadu

The CPI(M) party has moved the Supreme Court seeking 50 per cent OBC reservation in seats surrendered by Tamil Nadu in the All India Quota for medical courses.

New Delhi: CPI(M) has moved to the Supreme Court filing a petition seeking directions to the government to apply the Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of Seats in Educational Institutions and of appointments or posts in the Services under the State) Act 1993 granting 50% reservation to OBCs, 18% to SCs and 1% to STs in medical courses in Tamil Nadu.

The PIL has been filed through its Tamil Nadu's state secretary and seeks reservation in 'State surrendered seats in All India Quota seats' (other than in the Central institutions) in the state.

Further it asks the government to produce records pertaining to NEET-PG 2020 results conducted by National Board of examination for filling the All India Quota and set it aside or modify to accommodate the reservation enabled candidates. The results were published on 9th May 2020.

The party contends that not providing the sought reservation is unconstitutional and violates Articles 14, 15 and 21 of the constitution.

"In the previous years, the OBCs are denied reservations both Postgraduate as well as Undergraduate medical seats under All India Quota. Thus, they are denied thousands of seats every year which are transferred to General Category. During this current admission year 2020-21 also, the OBCs are not given a reservation for the seats pooled from the states," contends the party.

Two more similar PILs seeking reservation for medical courses have been filed in the top court which are pending.
