Centre to SC on Tablighi Jamaat case: More than 1500 emails were sent before visa cancellation and blacklisting

New Delhi:The Central government on Thursday informed the Supreme Court that blacklisting and cancelling visas of 3500 foreign nationals who attended Talibaghi Jamaat event at Nizamuddin Markaz in New Delhi was done on case to case basis and it was a plenary sovereign function.

Responding to the petitioners', Jamaat members, prayer they should be transported back to the their home countries and there was no notice given to them before the actions taken, Solicitor General, Tushar Mehta, said that the members are not only blacklisted but criminal charges are also pending against them. The Supreme Court will hear the matter on July 10.

"Right to return is never an enforceable right," remarked SG. He appraised the court that there were more than 1500 emails sent to these foreigners.

Advocate CU Singh, appearing for the members, argued that they sent 1500 plus mails as they didn't have other email ids and therefore, some of them did not receive the mails. He pleaded before the court to deport the members to their home countries and blacklisting should arise when they try to enter India.

According to the information, option will be open for petitioners to file rejoinder affidavit. Centre can also file copies of orders passed on visa cancellation for petitioners by email to counsels.

The bench led by Justice AM Khanwilkar said that if the orders were passed on case to case basis then they will have to approach the High Courts to challenge individual orders.

The top court asked the centre to file copies of orders on visa cancellation for petitioners by email to counsels and gave the petitioners liberty to file rejoinder or their response to centre in the court.
