In the controversial father-son duo’s custodial death case in Thoothukkudi, a Tamil Nadu based advocate on Friday approached the Supreme Court seeking a direction to Tamil CM to restrain from the state home department citing the probe and trials proceedings regarding the case.

New Delhi:A Tamil Nadu based advocate on Friday approached the Supreme Court seeking a direction to Chief Minister Edappadi K Palaniswami to restrain from the state home department citing the probe and trials proceedings in the controversial father-son duo’s custodial death case in Thoothukkudi.

Advocate Rajarajan submitted its inappropriate for Tamil Nadu CM to continue as home department head as the latter’s statement revealed that the victims were died only due to health-related ailments and not because of police brutality.

“A few days after the custodial death of Jayaraj and Fenix (Bennicks) in Sattankulam of Thoothukkudi, TN CM said Jayaraj died of age-related ailments and is son Bennicks died of respiratory failure. Even before the probe was launched on this father-son duo’s mysterious death, CM’s statement aired several doubts.

His statement categorically denied that it was not a murder. However, after the intervention of Madras High Court and continuous uproar from the opposition parties, common public and international society, the CBCID had arrested five cops in connection with the death of the two,” the petitioner said.

Since the CM had a different version on this matter should not continue as the head for the home department until the probe and trials are completed according to Rajarajan.

“The probe and trials are still undergoing. CM’s statement should be seen as a tool to protect the accused. So, we are seeking orders directing the TN CM to step down from the minister for the home department,” the petitioner said.
